Terms of Service

Effective October 31, 2026
These Terms of Service ("Terms") are an agreement between you and Firemind Web Design LLC, an Illinois limited liability company that operates VSEER ("VSEER," "we," "us"). They cover the VSEER mobile apps, the website at vseer.app, and everything else we provide under the VSEER name (together, the "Services").
By creating an account or using the Services, you agree to these Terms. Our Privacy Policy, also available in the app and at vseer.app/privacy, explains what information we collect and how we use it. If you do not agree, please do not use the Services.

1. What VSEER is

VSEER helps you rate the films you have seen, build a collection of them (your "Filmography"), discover new films, and share picks with friends. Recommendations are suggestions based on your activity and are not guaranteed to suit you.
Film information and images come from TMDB (The Movie Database). Where to Watch information comes from JustWatch through TMDB. VSEER does not host or stream films and is not affiliated with, endorsed by, or acting for TMDB, JustWatch, or any studio or streaming service. We do not check this information and cannot promise it is complete, current, or accurate. Always confirm availability and pricing with the streaming service itself.

2. Who can use VSEER

You must be at least 13 years old to use the Services. If you are under 18, you may use the Services only with the permission and supervision of a parent or legal guardian who agrees to these Terms for you. If you believe someone under 13 is using VSEER, please tell us at the email below and we will remove the account.
You may not use the Services if you are barred from doing so under the laws of the United States or any other place that applies to you.

3. The Services are free

VSEER is currently free to use and does not show ads or sell anything. If we ever add paid features or advertising, we will update these Terms and tell you before they apply to you.
You can choose to support VSEER with a tip on Ko-fi (ko-fi.com/vseer). Tips are entirely voluntary, do not unlock any features or give you any rights in the Services, and are handled by Ko-fi and its payment providers under their own terms. Tips are generally not refundable, but email us if something went wrong.
We are always changing the Services. We may add, change, limit, or remove features, or stop offering the Services altogether, sometimes without notice.

4. Your account

You can swipe without an account, but saving your ratings across devices, friends, and sharing require one. Please give a real email address and keep your password private. You are responsible for what happens under your account, and you should tell us right away at the email below if you think someone else has used it.
Your handle and name must not impersonate another person or business, use someone else's trademark without permission, or be offensive, vulgar, or hateful. We may change or reclaim a handle that breaks these rules. You can change your handle once every 30 days and your name at any time.
You can stop using VSEER at any time. To delete your account and the data tied to it, tap Delete account on the Account tab, or email us. Some information may stay in backups for a limited time, as explained in the Privacy Policy.

5. Your content

Your content includes your ratings, reviews, watchlist, collection, the recommendations you send, the avatar you choose, and anything else you add to VSEER. You keep ownership of your content.
Here is who can see it:
•
Other signed-in users can find you by your handle. Your name, avatar, and title can be seen only by your friends and by people with a pending friend request with you.
•
Your collection, ratings, watchlist, medals, and reviews can be seen only by people you have accepted as friends.
•
A recommendation you send can be seen by the friend you send it to, along with any note you add.
•
Your phone number, if you add one, is never shown to other users.
So that we can run the Services, you give VSEER a non-exclusive, worldwide, royalty-free license to store, copy, display, and process your content to provide and improve the Services, including showing it to the people listed above and using it to make recommendations. We may also use information about how people use VSEER in anonymized or combined form, which does not identify you, to improve the Services. This license ends when you delete the content or your account, except for anonymized or combined information and copies kept for a limited time in backups.
You are responsible for your content. By adding it, you confirm that you have the right to add it and that it follows these Terms and the law.

6. Imports, phone numbers, and contacts

You may import data from Letterboxd or from a film file only if it is your own data. VSEER is not affiliated with Letterboxd.
Adding a phone number is optional. We do not verify phone numbers, so add only a number that belongs to you. If you choose to match your contacts, VSEER uses them only to find friends who are already on VSEER, as described in the Privacy Policy. Only invite people who would want to hear from you.

7. Rules for using VSEER

Please be decent to other people. You agree not to post, send, or share anything that:
•
is illegal, threatening, harassing, hateful, defamatory, sexually explicit, or encourages violence or self-harm;
•
infringes someone else's copyright, trademark, privacy, or other rights;
•
pretends to be another person or business, or misrepresents your connection to them;
•
shares another person's private information, such as their address, phone number, or financial details;
•
is spam, advertising, or an unsolicited promotion; or
•
contains viruses or other harmful code.
You also agree not to:
•
access or try to access parts of the Services, our systems, or our providers' systems that are not meant for you;
•
probe, scan, or test the security of the Services, or get around any security or rate limits;
•
scrape, crawl, or copy the Services or their data by automated means without our written permission;
•
overload, disrupt, or interfere with the Services or other users, including by creating accounts or content with scripts;
•
use the Services to build a competing database or service, or to extract TMDB or JustWatch data; or
•
help anyone else do any of the above.
We do not tolerate abusive users or objectionable content. We may remove any content and limit, suspend, or close any account that we believe breaks these rules, puts others at risk, or exposes VSEER to legal risk.

8. Reporting a problem

To report content or a user, or anything else that breaks these Terms, email info@vseer.app with as much detail as you can, including the handle involved. We review reports and act on them when needed.

9. Our rights

The Services, including the VSEER name, logo, design, software, and medals, belong to Firemind Web Design LLC and its licensors and are protected by law. These Terms do not give you any rights to them except the right to use the Services as these Terms allow. Film data, posters, and images belong to their owners and are shown under license from TMDB.
If you send us ideas, feedback, or suggestions, we may use them freely without paying you or owing you anything.

10. Copyright complaints

We respect intellectual property rights. If you believe something on VSEER infringes your copyright, email info@vseer.app with the subject line "Copyright Complaint" and include:
•
your physical or electronic signature;
•
a description of the copyrighted work you believe was infringed;
•
where the material you are complaining about appears on VSEER, such as the handle and film involved;
•
your name, address, phone number, and email address;
•
a statement that you believe in good faith that the use is not authorized by the copyright owner, its agent, or the law; and
•
a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act for them.
These are the elements required by the Digital Millennium Copyright Act (17 U.S.C. § 512(c)(3)). Knowingly false claims can lead to liability for damages. We may remove material and close the accounts of people who repeatedly infringe.

11. Other services and links

The Services link to and rely on services run by others, such as TMDB, JustWatch, streaming services, and the app stores. We are not responsible for those services, their content, or their availability, and a link is not an endorsement. Your use of them is governed by their own terms.

12. Ending these Terms

You may end these Terms at any time by deleting your account and no longer using the Services.
We may suspend or end your access to all or part of the Services at any time if we reasonably believe you have broken these Terms, you create risk or legal exposure for us or others, or we stop offering the Services. When we can, we will tell you by email or in the app.
Sections 9 and 13 through 18 continue to apply after these Terms end.

13. Disclaimers

The Services are provided "as is" and "as available." To the fullest extent the law allows, Firemind Web Design LLC and its owners, employees, and agents ("VSEER Parties") disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
The VSEER Parties do not promise that the Services will be uninterrupted, secure, or error-free; that film, streaming, or recommendation information will be accurate or current; or that your data will never be lost. Please keep your own copy of anything important, for example by using the export option in the app.
Some places do not allow these disclaimers, so some of them may not apply to you.

14. Limits on our liability

To the fullest extent the law allows, the VSEER Parties will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, use, or goodwill, that result from your use of or inability to use the Services, the conduct or content of other users or third parties, or unauthorized access to your account or content.
To the fullest extent the law allows, the VSEER Parties' total liability for all claims relating to the Services is limited to the greater of one hundred U.S. dollars (US $100) or the amount you paid us for the Services in the six months before the claim arose.
These limits apply to any legal theory, even if we were told that damages were possible. Nothing in these Terms limits liability that cannot be limited by law.

15. Indemnity

To the extent the law allows, you agree to defend and hold harmless the VSEER Parties from third-party claims, and the related costs, including reasonable attorneys' fees, arising from your content, your use of the Services, or your breach of these Terms or the law.

16. Governing law and disputes

These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-law rules. Any dispute relating to these Terms or the Services will be brought only in the state or federal courts located in Illinois, and you and we consent to those courts' jurisdiction.
Before filing a claim, please email us so we can try to resolve the issue informally. You and we agree to bring claims only on an individual basis, and not as a plaintiff or class member in any class or representative action, to the extent the law allows.

17. Changes to these Terms

We may update these Terms from time to time. The current version will always be available in the app and at vseer.app, with the date it took effect. If a change is material, we will tell you in the app or by email before it applies. If you keep using the Services after a change takes effect, you accept the updated Terms. If you do not agree, please stop using the Services and delete your account.

18. General

These Terms and the Privacy Policy are the entire agreement between you and us about the Services. If any part of these Terms cannot be enforced, the rest stays in effect. If we do not enforce a part of these Terms, we have not given up the right to do so later. You may not transfer your rights under these Terms without our permission; we may transfer ours, for example to a company formed to run VSEER.

19. Apple and Google

If you downloaded VSEER from the Apple App Store or Google Play, these Terms are between you and Firemind Web Design LLC, not Apple or Google, and we alone are responsible for the app and its content. Apple and Google have no obligation to provide maintenance or support for the app. Apple is not responsible for any claims relating to the app, including product liability claims, claims that the app fails to meet legal or regulatory requirements, consumer protection or privacy claims, or claims that the app infringes someone else's intellectual property. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You also agree to follow the app store's own usage rules.
